Terms and Conditions
OVERVIEW
These Terms and Conditions ("Terms") govern all sales of products and services made through SolarBatteryCovers.ie by Life Tree Direct Ltd, trading as SolarBatteryCovers.ie ("we", "us", "our"), a company registered in Ireland, company number 765833, registered office at Derraugh, Mountrath, Co. Laois, R32 WT18. When you place an order with us, you are agreeing to be bound by these Terms in full.
We sell solar battery and inverter covers and related products as the Authorised Reseller in the Republic of Ireland for Battery Covers Ltd (company number 16195198, registered in England and Wales), who manufacture the Products. Our online store is operated via Shopify. Any purchase made through our website constitutes a contract between you and Life Tree Direct Ltd, not Shopify, and not Battery Covers Ltd.
These Terms apply to both individual consumers (B2C) and business/trade customers (B2B). Where your rights differ depending on whether you are a consumer or a business, this is clearly indicated.
Your statutory rights: Nothing in these Terms affects your statutory rights under Irish law, including your rights under the Consumer Rights Act 2022 (if you are a consumer) or applicable Irish and EU business sale of goods law (if you are a business).
SECTION 1 — DEFINITIONS
In these Terms, the following definitions apply:
- "Consumer" means an individual purchasing for personal, domestic, or household use, not in the course of a business.
- "Business Customer" means any person or entity purchasing in the course of a trade, business, craft, or profession.
- "Products" means the solar battery and inverter covers and related items sold through SolarBatteryCovers.ie, manufactured by Battery Covers Ltd.
- "Order" means a purchase order submitted by you through our website or otherwise in writing.
- "Contract" means the agreement formed between you and Life Tree Direct Ltd upon our acceptance of your Order.
- "Installer" means any competent person or company responsible for the physical installation of our Products at a premises.
- "Manufacturer" means Battery Covers Ltd, the manufacturer of the Products, of whom we are the Authorised Reseller for the Republic of Ireland.
SECTION 2 — ACCESS AND ACCOUNT
By using our website and placing an order, you confirm that:
- You are at least 18 years of age;
- You have legal capacity to enter into a binding contract;
- All information you provide to us is accurate, current, and complete;
- You will promptly update your account information if it changes.
You are solely responsible for maintaining the confidentiality of your account credentials. You must not transfer or assign your account to any third party. We reserve the right to suspend or terminate accounts where we suspect fraudulent or unlawful activity.
SECTION 3 — OUR PRODUCTS AND INTENDED USE
3.1 Product Description
Our Products are insulated aluminium enclosures, manufactured by Battery Covers Ltd and supplied to Irish customers by us as their Authorised Reseller. Our Products are designed to house solar battery and inverter systems and are installed externally on buildings with a ventilation gap between the enclosure and the wall surface. Our Products do not contain active electrical components.
We have made every reasonable effort to ensure accurate representation of our Products on our website. However, colours and appearances may vary slightly from those displayed on screen due to device settings and screen calibration. Product descriptions are subject to change without notice.
3.2 Intended Use
Our Products are designed and intended solely for:
- External housing of solar battery and inverter systems;
- Installation by a competent person in accordance with the manufacturer's installation guidelines.
3.3 Limitations of Use
Our Products are NOT intended for:
- Internal installation within occupied buildings without appropriate assessment;
- Use on buildings subject to enhanced fire safety requirements under Irish building control legislation, without prior written confirmation from us;
- Any use that conflicts with applicable planning permissions, building regulations, or fire safety requirements;
- Modification or alteration by any party other than the manufacturer, Battery Covers Ltd, without prior written consent.
3.4 Battery Manufacturer Compatibility
Where the manufacturer has obtained written confirmation from a battery manufacturer that our Products do not adversely affect the warranty of their product, this applies solely to the specific product tested. Such confirmation does not constitute approval for all configurations or uses.
3.5 Installation Requirements
Installation of our Products must be carried out by a suitably competent person. The following requirements must be observed at all times:
- The ventilation gap between the enclosure and the wall must be maintained as specified in the manufacturer's installation guidelines;
- All applicable Irish building regulations, fire safety requirements, and electrical regulations must be complied with;
- The enclosure must not be modified in any way that compromises ventilation, structural integrity, or fire performance;
- Installation must comply with the Safety, Health and Welfare at Work (Construction) Regulations 2013, where applicable;
- Any relevant planning consents must be obtained prior to installation.
Failure to follow installation requirements may affect the performance of the enclosure, void any warranty offered on the Products, and transfer liability for any resulting damage or injury to the Installer or Customer.
SECTION 4 — ORDERS AND CONTRACT FORMATION
When you place an order on our website, you are making an offer to purchase. No contract is formed until we send you an order confirmation by email. We reserve the right to decline any order at our discretion, without obligation to provide a reason.
Please review your order carefully before submission. Once an order has been accepted, cancellation may not be possible unless you have statutory cancellation rights (see Section 8, Returns and Refunds).
In the event that we are unable to fulfil your order, cancel it, or need to make changes, we will contact you using the details provided at the time of ordering. If payment has already been taken, a full refund will be issued promptly.
Business Customers: You represent and warrant that you have authority to enter into this Contract on behalf of your business and that any purchases are made in the course of that business.
SECTION 5 — PRICES, VAT AND BILLING
All prices displayed on our website are in euro (EUR) and are clearly stated as inclusive or exclusive of VAT. Where prices are shown exclusive of VAT, the applicable Irish VAT at the current rate will be added at checkout and shown on your invoice.
Prices are subject to change without notice. The price charged will be the price confirmed in your order confirmation email at the time of acceptance.
We accept payment by the methods listed on our website. Payment must be received and processed before an order is accepted and fulfilled. You warrant that you are authorised to use the payment method provided and that the details given are accurate and complete.
We reserve the right to correct any pricing errors on our website. If a pricing error is identified after your order has been accepted, we will contact you to confirm whether you wish to proceed at the correct price or cancel the order.
VAT invoices will be issued for all orders when requested. Life Tree Direct Ltd is a VAT registered business. Our VAT number is IE4327645KH.
SECTION 6 — SHIPPING AND DELIVERY
All delivery timeframes quoted on our website or in correspondence are estimates only and are not guaranteed. We shall not be liable for delays caused by third party carriers, weather, customs processing, industrial action, or other events outside our reasonable control.
Risk of loss and damage to Products passes to you at the point of delivery to your nominated address. Title to the Products passes to you upon receipt of full payment.
If your delivery is delayed or lost, please contact us at sales@solarbatterycovers.ie and we will investigate with the carrier. We are not responsible for losses caused by incorrect delivery addresses provided by you.
Consumers: If your order is significantly delayed beyond the estimated delivery date and the delivery date was essential to your purchase, you may be entitled to cancel the order and receive a full refund under the Consumer Rights Act 2022.
SECTION 7 — WARRANTY
7.1 Our Warranty
The Products carry the manufacturer's warranty, provided by Battery Covers Ltd and administered by us on your behalf as the Irish reseller. At the time of delivery, our Products:
- Are of satisfactory quality, free from material defects in materials and workmanship;
- Are fit for their intended purpose as described in Section 3;
- Conform to any description given on our website or in written correspondence.
The warranty period is 24 months from the date of delivery, unless otherwise stated in writing at the time of sale.
7.2 Warranty Exclusions
The warranty does not cover:
- Defects arising from incorrect installation, including failure to follow the manufacturer's installation guidelines;
- Damage caused by modification, alteration, or repair by any party other than the manufacturer;
- Fair wear and tear over time;
- Damage caused by weather events, vandalism, or other external forces;
- Damage caused by housing incompatible batteries or inverters or other hardware that is not a solar battery or inverter;
- Any issue arising from failure to comply with applicable building or electrical regulations.
7.3 Consumer Statutory Rights
If you are a Consumer, your statutory rights under the Consumer Rights Act 2022 are not affected by the above warranty. You have the right to products that are of satisfactory quality, fit for purpose, and as described. If a product fails to meet these standards, you may be entitled to a repair, replacement, or refund depending on the circumstances. All such claims are made against us, Life Tree Direct Ltd, as the seller of record.
SECTION 8 — RETURNS AND REFUNDS
8.1 Faulty or Misdescribed Products
If your Product is faulty or does not match its description, please contact us at sales@solarbatterycovers.ie within a reasonable time of discovery. We will arrange for inspection and, where applicable, a repair, replacement, or refund in accordance with your legal rights.
8.2 Made to Order Products — Right to Cancel Does Not Apply
Every Product is manufactured only after your order is placed, to the size, colour, insulation and lock specification you select at checkout. As these Products are made to your specification, they are exempt from the standard 14 day right of withdrawal under Regulation 6(3)(c) of the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013.
This means that, once your order has been placed and confirmed, you will not have a statutory right to cancel for change of mind. Please choose your size, colour and specification carefully before completing your order.
This exemption does not affect your rights under Section 8.1 if your Product is faulty or does not match its description, or your statutory rights under the Consumer Rights Act 2022 (see Section 7.3).
8.3 Business Customer Returns
Business Customers do not have a statutory right to cancel under the Regulations referred to in Section 8.2, and in any event our Products are made to order and excluded from that right for all customers. Returns by Business Customers are at our discretion and subject to agreement in writing prior to return. A restocking fee may apply.
SECTION 9 — FIRE SAFETY AND BUILDING REGULATIONS
Our Products are externally mounted, insulated aluminium enclosures. We can provide documentation relating to the fire performance characteristics of the materials used in our Products upon request.
It is the responsibility of the Customer, Installer, and building owner to ensure that the installation of our Products complies with all applicable Irish building regulations, including fire safety requirements relevant to the specific building and installation. This includes, but is not limited to, compliance with the relevant Technical Guidance Document under the Irish Building Regulations.
Customers installing our Products on buildings subject to enhanced fire safety or building control requirements should seek appropriate professional advice to confirm compliance with the additional requirements applicable to such buildings.
SECTION 10 — DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY
10.1 Products Provided As Described
Our Products are provided in accordance with the descriptions set out in Section 3 of these Terms. We do not make any representation or warranty beyond what is expressly stated in these Terms or in written correspondence.
10.2 Limitation of Liability — Business Customers
To the fullest extent permitted by applicable law, our total liability to Business Customers in connection with any order or contract shall not exceed the total price paid by you for the Products to which the claim relates.
We shall not be liable to Business Customers for any indirect, consequential, or special losses, including but not limited to loss of profit, loss of business, loss of anticipated savings, or damage to goodwill, whether arising in contract, tort, or otherwise.
10.3 Limitation of Liability — Consumers
If you are a Consumer, we do not seek to exclude or limit our liability beyond what is permitted by law. Nothing in these Terms limits our liability for:
- Death or personal injury caused by our negligence;
- Fraud or fraudulent misrepresentation;
- Any other liability that cannot be excluded or limited by Irish law.
10.4 Installation Liability
We are not responsible for any loss, damage, or injury arising from incorrect installation of our Products, failure to follow the manufacturer's installation guidelines, or failure to comply with applicable building or electrical regulations. Such liability rests with the Installer and/or Customer.
SECTION 11 — INTELLECTUAL PROPERTY
All intellectual property rights in the Products, including trademarks, designs, and product designs, are owned by Battery Covers Ltd and are used by us under licence as their Authorised Reseller. All intellectual property rights in our website, branding, content, and documentation are owned by Life Tree Direct Ltd or licensed to us. You may not reproduce, distribute, or use any of this intellectual property without our prior written consent.
These Terms permit you to use our website for the purpose of purchasing our Products only. Unauthorised use may constitute an infringement of intellectual property rights.
SECTION 12 — DATA PROTECTION AND PRIVACY
Life Tree Direct Ltd is the data controller for your personal data and processes it in accordance with the General Data Protection Regulation (GDPR) and the Irish Data Protection Act 2018. Our supervisory authority is the Data Protection Commission (DPC).
Our Privacy Policy, available on our website, sets out how we collect, use, store, and protect your personal data, and your rights in relation to that data. By placing an order with us, you acknowledge that you have read and understood our Privacy Policy.
We use Shopify to power our online store. Shopify may process certain data in connection with the provision of their platform services. Please refer to Shopify's Privacy Policy for details.
SECTION 13 — THIRD PARTY LINKS AND TOOLS
Our website may contain links to third party websites or tools. These are provided for convenience only. We are not responsible for the content, accuracy, or practices of any third party website, and a link does not constitute endorsement. You access third party websites at your own risk.
SECTION 14 — FEEDBACK AND REVIEWS
We welcome feedback on our Products and services. By submitting feedback, reviews, or suggestions to us, you grant us a perpetual, royalty free licence to use, reproduce, publish, and display that feedback for business purposes, including on our website and marketing materials.
You warrant that any feedback you submit is your own, is accurate, and does not infringe the rights of any third party. We reserve the right to remove feedback that we consider unlawful, defamatory, or otherwise inappropriate.
SECTION 15 — COMPLAINTS
We take complaints seriously and aim to resolve them promptly and fairly.

We aim to acknowledge all complaints within 3 working days and to resolve them within 14 working days. If we are unable to resolve your complaint within this timeframe, we will keep you informed of progress.
Consumers: If you are not satisfied with our resolution, you may be entitled to refer your complaint to an Alternative Dispute Resolution (ADR) scheme or to the courts. We will provide details of available ADR options upon request.
SECTION 16 — PROHIBITED USES
You may use our website and services for lawful purposes only. You must not:
- Use our services for any unlawful or fraudulent purpose;
- Infringe any intellectual property rights;
- Transmit any harmful, offensive, or malicious content;
- Attempt to gain unauthorised access to our systems;
- Resell our Products for commercial purposes without our prior written agreement;
- Export our Products in breach of applicable export control laws.
We reserve the right to suspend or terminate access to our services where we reasonably believe these Terms have been breached.
SECTION 17 — EVENTS OUTSIDE OUR CONTROL (FORCE MAJEURE)
We shall not be in breach of these Terms, nor liable for any delay or failure in performance, to the extent that such delay or failure results from events outside our reasonable control, including but not limited to acts of God, fire, flood, severe weather, pandemic, strikes, civil unrest, government action, or failure of third party suppliers.
If such an event occurs, we will notify you as soon as reasonably practicable and take reasonable steps to minimise the impact on your order.
SECTION 18 — TERMINATION
We may suspend or terminate your access to our services at any time without notice if we reasonably believe you have breached these Terms. On termination, all outstanding payment obligations remain due.
Sections relating to Intellectual Property, Limitation of Liability, Governing Law, and any other provisions that by their nature should survive termination shall continue in full force following termination.
SECTION 19 — GENERAL
19.1 Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be severed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
19.2 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
19.3 Entire Agreement
These Terms, together with our Privacy Policy and any order confirmation, constitute the entire agreement between you and Life Tree Direct Ltd in respect of your purchase, and supersede all prior representations, agreements, and understandings.
19.4 Assignment
You may not transfer or assign your rights under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms without notice to you.
19.5 Changes to These Terms
We reserve the right to update or amend these Terms at any time. Changes will be posted on our website and will take effect from the date of posting. Your continued use of our services following any changes constitutes acceptance of the updated Terms. We will notify you of any material changes by email where we hold your contact details.
SECTION 20 — GOVERNING LAW AND JURISDICTION
These Terms and any Contract formed between you and Life Tree Direct Ltd shall be governed by and construed in accordance with the laws of Ireland.
Business Customers: Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Ireland.
Consumers: If you are a Consumer resident in another EU member state, you may also be entitled to bring proceedings in the courts of your country of residence. Nothing in this clause affects your right to seek relief in the courts of your country of residence.
